Q: |
|
When can I expect to receive a distribution?
|
| |
|
A: |
|
Any distribution of proceeds cannot take place
until final judicial approval of the settlement and plan of allocation. At this time,
we anticipate that distributions may be made sometime in 2005, although there are
various contingencies that could delay the time when it is possible to make a
distribution of the settlement proceeds.

Q: |
|
I now wish to opt out of the Class. Is it too late?
|
| |
|
A: |
|
Yes. The deadline for opting
out of the Class was until September 1, 2004. By way of background, pursuant
to the Notice of Class Action, members of the Class had the right to opt out of the Class
only by written request postmarked on or before February 20, 2004. However, by Order
of the United States Court of Appeals for the Second Circuit, the deadline for Class
Members to request exclusion from the Class was extended to a date to be fixed by
further order of the Court. That deadline was subsequently set as September 1, 2004.
